Ignition Interlock Pilot Program for DUIs

As a Fresno DUI offender, you could be facing multiple consequences such as harsh penalties, license suspension, mandatory alcohol and/or drug programs, ankle monitoring, ignition interlock or even potential jail time.

A reputable DUI Attorney can not only help you get the best possible sentencing but can also provide you with the necessary information to make an informative decision regarding your specific case. One of the penalties of being arrested for a DUI in Fresno is to have an ignition interlock device installed into your vehicle. This device, commonly referred to as an “IID”, attaches to your steering wheel and requires that you blow into it so that it can check if any alcohol is on your breath.

As of July 2010, all first time DUI offenders in the Tulare, Alameda, Los Angeles and Sacramento Counties will be required to install an Ignition Interlock Device for a minimum of 5 months or 12 months if there was an injury.  Second time DUI offenders will be required to keep the IID installed in their vehicles for a minimum 12 months as well as be eligible for a restricted license after 90 days of having the Ignition Interlock Device installed.

      DUI Checkpoints in Fresno County

      May. 21st 2012

At any given point during the week, it is not uncommon to find police officials setting up a roadblock or a DUI sobriety checking in Fresno. Orange cones are placed, turning a multiple lane street into a one way road, forcing motorists to inch towards the officers one by one. Drivers are then asked a series of questions, have their eyes looked at and even may have their cars sniffed by the questioning officer in the search of a drunk driver. If you happen to exude any signs of potential impairment, you are then asked to step out of the vehicle and perform several DUI field sobriety tests and may be arrested if the officer thinks you are failing.

DUI sobriety checkpoints are great, in theory. In reality, they violate the Fourth Amendment, are ineffective and are typically used to cash in on unlicensed drivers. Several states have already began to ban sobriety checkpoints such as Idaho, Iowa, Montana, Rhode Island, Washington, Wisconsin, Wyoming, Oregon and Minnesota with Texas and Alaska prohibiting them for other legal reasons.

If you are arrested during a DUI checkpoint, it is imperative that you contact a driving under the influence attorney to make sure that the arrest was done so lawfully and within the specific guidelines. Call us today at 559-233-3724 or fill out our FREE Fresno DUI Case Evaluation to have our dedicated Fresno DUI lawyers contact you directly!

      Marijuana DUIs in Fresno

      May. 21st 2012

As a California driver in Fresno County, you know that it is illegal to drive while under the influence of alcohol and drugs. But what if you are a medical marijuana user? The state of California still makes it illegal to drive while under the influence of drugs, which includes marijuana, regardless if it is medical or not.

If you are pulled over on suspicion of driving under the influence in Fresno, an officer will conduct several Fresno DUI field sobriety tests as well as a breathalyzer and/or blood test. The breathalyzer will provide officials with a certain percentage, if you have been drinking, but do not provide any information on whether you had been smoking marijuana. The blood test would determine if any trace of alcohol and/or drug is in your system.

Unfortunately, those who use marijuana for medical purposes may be in trouble as the traces of THC (Tetrahydrocannabinol) linger in the body for a much longer period of time. If you or someone you know has been arrested for a DUI, contact our leading DUI Attorney’s today at 559-233-3724! We will provide you with legal advice throughout your entire case!
